Miraheze is obligated to investigate claims of potential copyright infringement and action them accordingly. Miraheze will verify the veracity of a claim and, if required, will remove the infringing material. The method for reporting copyright infringement depends on whether you are the copyright holder or not, please see below for more information.

Sometimes the fastest resolution may be achieved by contacting local administrators first, if you know how to contact them and if you know they're responsive. It may be best to send them a message explaining you want the work removed as you did not give authorization to post the work, and providing examples of work ownership. It may also be helpful to point to this page. If they are unresponsive or refuse to cooperate, you may continue with the following.

If you are the copyright holder of a work you believe is being infringed on Miraheze, you must file a report with the WikiTide Foundation by sending an email to dmca@wikitide.org.

Non-copyright holders

If you believe a work on a wiki potentially infringes on someone else's copyright, but you are not the copyright holder, please contact Stewards or email stewards@miraheze.org.

Stewards will process your request, action it accordingly, and inform you of the outcome. If you believe Stewards are taking an unreasonable amount of time to respond to a request, please contact Trust and Safety by making a report via TSPortal.

Under the Content Policy, Stewards handle copyright complaints from non-copyright holders, so any request made to Trust and Safety will be redirected to Stewards first.

Filing a counter-notice

Where possible, Trust and Safety will inform the uploader of the work deemed to be infringing copyright that their upload has been removed pursuant to a copyright claim. The uploader in question may then issue a counter-notice if they believe the content does not actually violate any copyright statues. We will then contact the original requester and inform them of the counterclaim. Miraheze is unable to provide you with any legal help or advice, so it is recommendable that you contact a lawyer before issuing a counter-notice to enquire deeper on the subject.

If the uploader believes that the material was removed as a result of mistake or misidentification of the material, the uploader may submit a counter-notice requesting the reinstatement of the material. To be effective, a counter-notice shall contain substantially the following information:

  1. a physical or electronic signature of the user;
  2. identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. a statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. the user’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Following receipt of a compliant counter-notice, the Foundation shall restore access to the material after no less than ten and no more than fourteen business days, unless the original notice sender informs the Foundation that it has filed a court action against the user.
